PARTICIPATION TERMS & CONDITIONS
These terms and conditions (“Terms”) govern your participation in the ANZ Producer Marketplace event (the “Event”) organised by Icon Conference and Event Management Ltd. (ICON) (” Organiser”). By registering for and participating in the Event you agree to comply with these Terms.

Registration: All participants must register for the Event through the official registration process. Registration details provided must be accurate and complete. By registering for the event you agree to receive communications in relation to the event and for your details to be provided upon request by sponsors and partners as listed in the Privacy section. Registrations are on a first come first serve basis, and participation is subject to availability. The Organiser reserves the right to reject any registration or cancel registration should the participant not comply with these Terms.

Fees and Payments: Participation as an exhibitor in the Event requires payment of a registration fee. This is non-refundable, payment must be made upon registering for the Event.

Health and Safety: By registering and participating in the Event, the participant agrees to comply with all health and safety requirements in relation to the venue and Event. Specific health and safety briefings will be provided prior to the Event for each event, specific to each venue and setup.

Images and Filming: By participating in the event, the participant acknowledges and accepts that photography, filming and broadcasting of the event will take place at the venue. The participant also confirms that ANZ producer marketplace, its sponsors and partners will own all rights (including copyright) in all photographic/video images taken of them during the event and have full permission to use for any post promotional purpose with no additional compensation. . If you have any issues with this, please let us via email at events@iconevents.co.nz and we will manage this for you.

Personal Information: We may collect, store, and use your information to conduct this Promotion/Event and for future promotional and publicity purposes. 

PRIVACY POLICY

Icon Conference and Event Management Ltd. is committed to protecting your privacy. We have robust systems in place to provide you with services and information tailored to your individual needs while complying with our obligations under the New Zealand Privacy Act 2020 (Privacy Act).

The Services (as defined below) are intended for use by people located in New Zealand and are not intended for use by anyone located outside of New Zealand.

References to “we”, “us” or “ANZ Producer Marketplace” in this Privacy Policy means ANZ Producer Marketplace.

We may change this Privacy Policy from time to time and we will tell you about a change in the Privacy Policy by updating the “last updated” date on our website. Unless otherwise stated, any changes to the Privacy Policy will take effect immediately upon being placed on the website and your continued use of the Services will represent an agreement by you to be bound by the Privacy Policy as amended.

This Privacy Policy applies to any personal information that we collect when you interact with us, including when you:

●      supply information to ANZ Producer Marketplace website;
●      send a query or complaint to the website; and/or
●      any other services we provide now or in the future, (together, the Services). 

In the event of any inconsistency between this Privacy Policy and other policies or terms and conditions that may apply to your use of any of the Services, the terms of this Privacy Policy will prevail.

From time to time we may collect or request personal information from you in the course of providing you, or by you accessing and using, the Services.  Personal information is any information about you that identifies you, or by which your identity can reasonably be ascertained.

The type of personal information we may collect when you access and use the Services includes your name, postal and delivery address, email address, phone number and any other information that we request.

Providing personal information is voluntary, however, if you do not provide us with some of this information then you may not be able to access some or all of the Services.

We collect personal information in order to provide you with, and allow you to access and use, the Services.

By accessing and using the Services you agree that we may collect, store and use any of your personal information including to do any of the following:

●      To assist in providing the Services that you request, including to contact you about your use of the Services.  For example, if you made a query or complaint, we may contact you about your query or complaint;
●      To take actions required to keep your information secure;
●      To enhance your overall experience of the Services;
●      To build a view of you as a customer by collating personal information that Icon Conference and Event Management Ltd, and our partners and service providers, hold about you, so that we can analyse and improve your experience and the services provided to you by Icon Conference and Event Management Ltd; and 
●      Such other purpose we make known to you at the time of collection.

In doing so, your personal information may be combined with other personal information held by ICON, our partners and service providers.
Where possible, ICON will collect your personal information directly from you.

5. Do we disclose personal information to anyone else?

In providing you with, or by you accessing and using, the Services, including where you register for an account to use the Services, we may sometimes need to disclose your personal information to others. By using one or all of the Services you agree that we may disclose your personal information for any of the purposes listed in the above section to:

●      Visa
●      ANZ
●      ICON
●      a third party outside of ICON who is a sponsor or partner that is able to provide a particular service to you for the purposes of business development; and
●      third parties when we believe in good faith that we are required to do so by law. 

You consent to the disclosure of your personal information to the parties listed above.

6. Cookies and tracking

When you access ANZ Producer Marketplace website or associated social media pages we may use cookies to track your use of the Services so that we can provide you with the best possible experience. A cookie is a small piece of data that a website sends to your browser that may be stored on your system. Some information/services may be unavailable if you chose to disable your browser from accepting cookies.

We may use the information generated by cookies to:

●      track traffic patterns to and from the website;
●      ensure any content (which may include any advertising) is being shown to the most appropriate person; and
●      enable us to serve targeted advertising to you (on our website and elsewhere).

By using the Services you consent to the storing and accessing of cookies or other information on your device in connection with your use of the website.

7. Analysis tools

We use various web and/or email analytics tools to collect information about your activity when you use the Services through our website.  The information we collect through the use of such analytics tools may be information about you (e.g. products or services that you engage with on the website) or anonymous information (e.g. the number of visitors per day or the average amount of time spent on the website).  By accessing and using our website, you consent to our use of such analytics tools to collect information about your access and use of the Services through our website.

9. Security of personal information

Security of personal information is very important to us and we will take all reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.  However, you acknowledge that security of the transmission of data over the internet can never be guaranteed, and it is your sole responsibility to protect access to any emails you receive from us that provide access to your account. To the maximum extent permitted by law, Foodstuffs will not be liable for any direct or indirect damage or loss if any third party gains unauthorised access to your information.

10. Accessing, correcting and updating personal information

Your personal information will be held by Icon Conference and Event Management, Unit 3, Level 3, 58 Surrey Crescent, Auckland and/or by one or more of ICON’s trusted data service providers. Under the Privacy Act you have the right to access your personal information that we hold, and to have that information corrected and/or updated. To access, correct or update information we hold about you please contact us at events@iconevents.co.nz. We will rely on the information that you have provided us so please ensure that information is accurate and kept up-to-date.

If you find that information we hold about you is incorrect, please contact us immediately and we will correct it.  Our contact details are above.

The following terms and conditions govern your use of this Site, including any service or content we provide you via the Site (together, the Online Services), so please read them carefully.

While every endeavour has been made to supply accurate information, errors and omissions may occur. Accordingly, we do not accept any liability for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission, whether negligent or otherwise, contained on or accessed through the Online Services.

By using the Site and/or registering for the event or to receive any Online Services you are deemed to have read and agreed to these terms and conditions.  If you do not agree to these terms you should cease using the Online Services.

2.0 WHAT CAN I USE THE ONLINE SERVICES FOR?

The Online Services allow you to find out information about the ANZ Producer Marketplace, its events and training sessions, promotions and competitions. We are not responsible if you use the Online Services for any other purposes.

3.0 REGISTRATION

Access to some Online Services may require registration or provision of your information, for example, if you fill in a form to contact us. You agree that all information you make available to us when registering or using the Online Services is true, accurate, up to date, complete and not false, misleading or deceptive in any material way.

To the maximum extent permitted by law, we and associate sponsors will not be liable, whether in contract, tort or otherwise, for any loss, damage or injury arising directly or indirectly from any use of the Online Services or any third party gaining unauthorised access to your personal information.

4.0 ACCESS

You understand that we may at any time in our sole discretion and without prior notice to you, prohibit or restrict your access to the Online Services.

We will use reasonable endeavours to keep the Online Services free from viruses and from unauthorised access.  However, we do not warrant that the Online Services will always operate uninterrupted or error-free or that any files available for downloading by you will be error-free or free from viruses, faults or defects.

5.0 WHO OWNS THE CONTENT OF THE ONLINE SERVICES?

The Online Services contain intellectual property and other proprietary information.  We or associate sponsors either own or are authorised to use the intellectual property in everything that you hear, read, download or access on or via the Online Services (including messages, files, data, software, images, photographs and other materials).  You are not permitted to do anything which infringes these intellectual property rights (such as copying, modifying or reposting content) unless you have express permission from us.

6.0 WHAT ABOUT LINKS TO OTHER SITES?

We have not reviewed all of the sites that may be linked to the Online Services.  We are not responsible for the content or accuracy of any off-site page or other sites linked to the Online Services.  You use any linked sites at your own risk.

7.0 THINGS YOU MUST NOT DO

You must not disrupt or interfere with the Online Services or servers or other software, hardware or equipment connected to or via the Online Services. You must not break any relevant law which applies to the use of the Online Services. If you do any of these things or otherwise use the Online Services inappropriately or maliciously you will indemnify us for any loss we suffer in connection with what you have done.

8.0 INFORMATION ON THE ONLINE SERVICES

We will endeavour to keep information on the Online Services as accurate and up to date as possible.  However, the Online Services may have some material which is not accurate or up to date in all respects or errors or omissions may occur.  For this reason, we do not warrant the accuracy or completeness of the information and, to the extent we are able to by law, we do not accept any liability for any errors on the Online Services.

We may update information on the Online Services at any time and without notice.

We disclaim (to the maximum extent permitted in law) all liability for any damage or loss resulting from your use of, or reliance on, the Online Services or the information provided via the Online Services.

9.0 COLLECTION OF PERSONAL INFORMATION AND YOUR PRIVACY

We may need to obtain personal information from you in the course of providing the Online Services to you.  Personal information is any information about you that identifies you, or by which your identity can reasonably be ascertained.

10.0 HOW CAN THE TERMS BE CHANGED

We can change these terms and conditions at any time, without notice to you by updating them on the Site.  The revised terms will take effect when they are posted and your continued use of the Online Services means you agree to our revised terms.

11.0 GOVERNING LAW AND DISPUTES

The Online Services are governed by New Zealand law.  If we have any issues which need to be resolved by a court, you agree to the exclusive jurisdiction of New Zealand courts.
